Yes. The agent says so in its first sentence, along with a recording notice, and confirms it whenever it's asked. If a caller asks not to be recorded, it stops recording the audio and carries on.
By default, nowhere outside your hardware. Speech-to-text, the language model and the voice run locally, and recordings stay in your own database for a retention period you set. A cloud model is optional and only ever sees pseudonymised text.
